Terms and Conditions of Service



Our previous Terms of Service and Acceptable Use Policies were extremely long and complex. We worked on simplifying things down, and this is what we came up with. It's not very lengthy and is relatively easy to read and understand. Please be sure that you have read this at least once. If you have any questions, please contact us.

Awareness and Acceptance


MyUnixHost.com (herein referred to as "we", "us" or "our") provides hosting services ("Services") to you, which are subject to these Terms and Conditions of Service. You must accept the terms of this Agreement in order to use the Services.


Accounts and Registration


Each person may have only one account. You may not create an account for an individual who is not yourself, unless you are assisting someone who is impaired and unable to complete the registration process on their own.

You must provide complete and accurate information about yourself during the registration process ("Registration Information").

We will handle Registration Information in accordance with our Privacy Policy.

A waiver may be applied for and granted, at our sole discretion, to provide for anonymous registration under specific circumstances.

Billing and Refunds


We operate on a pre-pay basis. Your account must have funds in it before your services are activated. Your account balance will then be reduced by any charges that are incurred by your usage of our services, or will be increased by any credits we may provide.

When your account balance is reduced to $0.00 (or less), your services will be immediately suspended. Once your account balance is brought back up, service will be restored immediately. You will have thirty (30) days once services are suspended to add funds to your account and have services restored. After the thirty (30) days, your account will be terminated completely, and all data you have stored on our systems will be removed entirely.

If at any time you become displeased with our services, we will happily refund any funds that remain in your account at the time you request a refund. Prior to our issuing a refund, if there are any outstanding charges that have not been billed to your account yet, they will first be charged to your account. Your remaining balance will then be refunded to you. Once a refund is issued, your account will be closed. If you have registered domains through us, they must be transferred or abandoned prior to account closing.

We will try to issue the refund via the payment method you used to fund your account. If for whatever reason we are unable to do this, and your account balance is greater than $1.00, we will offer to mail a physical check for the refund amount, less a $1.00 charge to cover the cost of doing this. If the amount to be refunded is less than $1.00, it will be considered an unrefundable credit.

We may also offer additional membership levels, which carry an annual membership fee. We may, in our sole discression, offer a partial refund of this fee, if during the period covered by the membership you decide to terminate that membership (or your account entirely). The partial refund is subject to the above rules.

Content and Acceptable Use


You are solely responsible for any and all content that you make available using our services. You may not upload, publish, or otherwise use our services to make available any content that:

  • violates the laws of the United State of America, or
  • you are prohibited by contract from distributing, or
  • infringes upon intellectual property rights or copyright laws, or
  • you otherwise do not have the legal right to distribute.

We reserve the right to terminate your account if you violate these rules. We do our absolute best to keep our noses out of your business. We believe in freedom of speech, even if we don't agree with what you're saying. But we must follow all applicable laws, even if we may disagree with some of them.

You are solely responsible for following any international laws that may apply to you.



You indemnify and hold harmless MyUnixHost.com and its subsidiaries, affiliates, owners, officers, directors, agents, partners, employees, and contractors from any and all claims, demands, losses, causes of action, damages, lawsuits, and judgments, including attorneys' fees and costs, arising out of or relating to your content, your use of our services, or your activities in conjunction with the services.

Changes to Service Offerings


We reserve the right at any time to modify or discontinue, either temporarily or permanently, our services or any portion thereof, with or without prior notice.

Security and Availability of Content


We make a good faith effort to provide our services in a reliable and consistent manner. We also take every conceivable action to make our services as secure as possible. This includes securing your content. We may take certain actions that we deem necessary to secure our services or your content.

While we make this good faith effort, no guarantee is made that it will be or remain secure. It is your sole responsibility to secure your content, and restore it in the event of loss or failure.



We reserve the right, at any time and for any reason, including but not limited to your violation of these Terms and Conditions of Service, to limit, suspend, or terminate your use of our services, and to discard any of your content. Such termination may be performed without prior notice, and we may immediately deactivate and/or delete your content, and bar you from all access to said content and our services. We will not be liable to you, or any third party, for any termination of your access to our services.

If we terminate your service because you violated these Terms and Conditions of Service, we reserve the right to retain, in portion or in whole, any balance of funds that remains in your account as liquidated damages. You remain liable for any and all damages you cause us or our members by your violation of these Terms and Conditions of Service.



Your use of our services is entirely at your risk. Our services are provided on an "as is" or "as available" basis. We expressly disclaim all warranties of any kind, whether express or implied. We make no warranty that our services will meet your requirements, or that our services will be uninterrupted, secure, or error free. No information or statements obtained by you from us or our officers, owners, directors, employees, or contractors, either oral or written, shall create any warranty not expressly stated in these Terms and Conditions of Service.

Limited Liability


In no event shall we have any liability whatsoever for damage, unauthorized access to, alteration, theft or destruction of information provided to us, distributed or made available for distribution via the services. We shall have no liability under this agreement or otherwise for consequential, exemplary, special, incidental, or punitive damages even if the company has been advised of the possibility of such damages. In any event, our liability to you for any reason and upon any cause of action shall be limited to the funds contained in your hosting account. This limitation applies to all causes of action in the aggregate, including, without limitation, to breach of contract, breach of warranty, negligence, strict liability, misrepresentations, and other torts. The fees for the services set by us under this agreement have been and will continue to be based upon this allocation of risk. Accordingly, you hereby release us from any and all obligations, liabilities, and claim in excess of the limitation stated in this section. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states, our liability is limited to the extent permitted by law.



Notifications to you may be made through regular mail, email, via our website, or during the normal course of providing our services to you.



It all boils down to this: Don't do anything stupid or illegal. If you follow those simple rules, life is good. We won't censor your content in any way, unless it violates applicable laws. Be kind to us, and we'll be kind to you.
